PPWR Regulation on Packaging and Packaging Waste

2025/40 Regulation on Packaging and Packaging Waste (PPWR) of the European Parliament and of the Council will apply from 12 August 2026 primarily to economic entities that place packaging on the market in the internal market of the European Union, either empty or with a product. Of course, this also applies to manufacturers and importers.

At the same time, in order to implement the PPWR Regulation, the obliged economic entities will have to request a wide range of data from the suppliers of packaging raw materials (e.g. printing houses, plastic and paper product manufacturers, etc.) in order to fulfil their obligations. Thus, the Regulation may give packaging material manufacturers and even their suppliers new tasks.

Economic operators who are the first to place packaging on the EU internal market (both manufacturers and importers) will have to prove the environmental compliance of the packaging. They will have to do this by carrying out a so-called conformity assessment procedure, at the end of which an EU declaration of conformity will be issued for each package.

In the course of the conformity assessment procedure, they must prepare technical documentation that is suitable for the analysis and assessment of the risks of compliance or non-compliance. In addition, they must describe the applicable requirements together with a description of the design, production and operation of the packaging.

First, we make an inventory of the packaging placed on the market, its ingredients, the available data and information, and the deficiencies.

We can then provide assistance with a general description of the use of the packaging, as well as with the compilation of a list of the harmonized standards, common specifications and technical specifications used for measurement and calculation purposes, as well as the itemized evaluation of the packaging and its components based on these. Of course, it is the responsibility of the distributors of the packaging to provide the design and production drawings, the description of the materials of the components, and the description of the drawings, but these documents have probably already been prepared during the so-called internal market surveillance procedure.  

Finally, we compile a Declaration of Conformity with the content defined by the PPWR Regulation.

It is very difficult and costly for obligated parties to comply with their obligations under the PPWR Regulation if they do not receive the necessary data and information from packaging material suppliers. For example, without supplier declarations for so-called substances of concern, they have to carry out analytical tests to exclude them. Therefore, they contact their suppliers, who do not always have accurate knowledge of what and how to provide their customers and how to access the requested information.
